There must be a side-quest, when you finished, the 5-star Hotel will be unlocked and you can just buy it and build it.
Plus, you must be on certain Level in the game, i think.

It starts out as a side-quest to build an opera theater, and the 6th step in the mission will be to build the 5-star hotel and that is when is becomes available to purchase. This wiki page explains it:

I think you need to be at level 21 to build the hotel.

To build a Five-Star Hotel requires you to Complete a mission: A Thirst for More, which is the 5th mission on the above wiki.
